New York State is on a mission – Pay your taxes (plus up to 16% interest) or they’ll put you out of business!

The Ugly Truth: The State won’t close you down directly – rather, they’ll simply take all of your money and cause you to default on all of your payments – this way, the Bank and your creditors get to do the dirty work (you might even get divorced). And when everything is said and done, you’ll still owe the State - and as a little reminder of this catastrophic failure, you’ll have a whopping judgment following you around for the next 20 years.

Unfortunately, many of these “judgments” aren’t worth the paper they’re printed on. For example, the NY Department of Labor recently slapped a small restaurant with a $107,000 penalty. The result - the restaurant must close its doors and their employees are out of work and out on the street. In this and many other cases, the “debt” will never be repaid. Accordingly, the State is carrying worthless receivables around as if they’re real assets, without any possibility of collecting. Moreover, irrespective of the claims, the State doesn’t like to compromise its liabilities (worthless or otherwise).

FYI Disgruntled former employees claiming to have been paid beneath the minimum wage, regularly target restaurant-owners by filing complaints with the Department of Labor. Astonishingly, in many of these cases, the claimant is lying but gets away with it all the same. The solution – keep good records and stop paying these future claimants in cash.

Selig and Associates Saves the Day: Identity Thieves can Ruin your life

On Martin Luther King’s Birthday, Selig and Associates began representing pro bono a single mother whose social security number was stolen. To this end, identity thieves have been using her name and social security number to file fraudulent income tax returns in New York, California and Mississippi.

From the IRS: An Identity Thief (who had been filing fraudulent 1040 tax returns in other people’s names do he could pocket those juicy refunds) was recently sentenced to 33 months in prison and ordered to pay $787,086 in restitution. At sentencing, his hapless “partner in crime” received a lighter sentence of 15 months in prison and ordered to pay only $104,662 in restitution.

According to the Court, from May 2008 through July 2010, these two crumb-bums conspired (with several other identity-stealing criminals who for some unfathomable reason, managed to avoid prosecution) to defraud the United States (not to mention their actual victims) by misappropriating social security numbers and filing false tax returns. Ouch!

NYS Tax Department Discovers Gold & Strikes it Rich!

For time and memorial, New York City Restaurants have been the Darling of the Tax Department. And now (thanks to reality television and the proliferation of celebrity-owned restaurants) overzealous tax collectors are cashing in on the Craze, says David Selig of Selig and Associates.

But celebrities aren’t the only one’s who are feeling the pinch, says Selig. For example, a tasty little Curry House on the Upper East Side was recently closed by the Tax Department because it owed less than $400 Thousand in sales and corporate taxes. A few days later, the Tax Department seized another restaurant in the East Village; then padlocked a yummy Pizza franchise in the Bronx. Then it was back to Chelsea to shutter another Pizzeria that allegedly owed $122K in Unpaid Taxes; then back uptown to kill a few more dreams. Ironically, says Selig, almost all sales tax controversies are resolvable, provided the owners’ get involved early on.

Non-Filer gets the SHAFT! Failure to File Tax Returns


ALBANY - Attorney General Eric T. Schneiderman and New York State Commissioner of Taxation and Finance Thomas H. Mattox announced today the arrest (NAME OMITTED) , 50, of (ADDRESS OMITTED) on three felony charges, stemming from his failure to file personal income tax returns.

“When individuals dodge paying taxes, the burden falls on honest taxpayers who have to foot the bill,” said Attorney General Schneiderman. “Our office will prosecute those who flout the law and fail to pay their taxes.”

“Our system of taxation relies on each of us to voluntarily comply with our tax responsibilities to fund vital local and statewide services,” said Commissioner Mattox. “Tax evasion is a crime, and we work closely with our law enforcement partners to ensure fairness for the millions of New Yorkers who meet their filing obligations every year.”

According to the complaint, the Defendant failed to file personal income tax returns for the tax years 2005, 2006, 2007, 2008, and 2009.

If convicted, the defendant faces a maximum sentence of one and one-third to four years of incarceration.

The case is being investigated by NYS Tax Department Investigator Anthony Vano.

The case is being prosecuted by Assistant Attorney General Joshua Vinciguerra of the Criminal Enforcement and Financial Crimes Bureau.

NY Tax Department to Public - Peck, Punch & Pulve

To collect unpaid taxes, the New York State Department of Taxation and Finance is allowed to garnish 10% of your pay - this means the State can contact your Employer and legally attach your Salary. Unfortunately, this wasn’t enough for the State - so after some late-night wrangling and some old-fashioned politicking, our elected officials decided to give the Tax Department Carte Blanche.

When you consider how bad the economy has been, and when you consider how high our taxes actually are - it’s not surprising that so many people nowadays have tax problems, said David Selig during a recent nationally televised interview.

Unfortunately, most Tax Collectors think you’re a Criminal. Accordingly, if you’ve fallen behind with your taxes, most Tax Collectors are going to treat you like a criminal, says Bradley Dorin of Selig and Associates.

In fact, behind closed doors Tax Collectors use their own “clandestine code” when determining just how punitive your punishment should be. For example, there are three levels of enforcement that most Tax Collectors unilaterally dispense.

These levels of enforcement are known as the “Three P’s” The Peck, The Punch and The Pulverizer.

The Peck: The Tax Department garnishes 10% of your gross salary.

Why won’t the IRS and State allow non-filers back into the fold without the fear of penalty or prosecution? As a Tax Practitioner and Advocate, I’ve seen so many good peoples lives ruined by taxes. And when it comes to submitting to governmental authority (filing taxes, etc.,) these same people become emotionally debilitated.

Over the past three years, my colleague Attorney Bradley Dorin has done extensive research on this very subject. In fact, after consulting with several psychologists and psychiatrists, we have come to believe that this condition “Taxpayer Anxiety Disorder” is a derivation of generalized anxiety disorder.

This notwithstanding, I’m not a medical professional - so I’ll limit my opinions to taxes. Accordingly, by not prosecuting or otherwise penalizing people with TAD, the government would save approximately 750 Million Dollars each year in ineffective enforcement costs (and simultaneously receive billions in previously uncollected taxes). For example, when the government prosecutes an individual for tax evasion, it’s not uncommon for that person to bankrupt himself (which makes the government’s judgments worthless).

Moreover, when the government wins a conviction, the taxpayer is stuck picking up the tab - and an otherwise productive person languishes away in prison and contributes nothing to society. Of course, the government doesn’t always win, and as such, all of the money and resources were wasted. Alternatively, by bringing these same people into compliance, the government will receive in excess of 80 Billion Dollars a year in revenues, that are presently going unreported (this amount represents approximately 6% of revenues received from individual 1040 filers).
